Application To Licence Private Hire Vehicle pdf icon PDF 81 KB

Minutes:

The Senior Licensing and Registration Officer submitted a report to the Sub-Committee regarding an application made by Mr B R Leigh to licence a Silver Mercedes E200 sport vehicle registration EK61 OVZ as a private hire vehicle to seat 4 persons.  The vehicle was pre-owned and was first registered at the DVLA on 28 September 2011. 

 

Mr B R Leigh attended on behalf of the applicant in support of the application and the Sub-Committee adjourned the meeting in order to view the vehicle.

 

Upon inspection of the vehicle the mileage was confirmed as 64,494 miles.

 

The Senior Licensing and Registration Officer informed the Sub-Committee that the application fell outside the Policy guidelines for the first licensing of vehicles and which would normally be refused; however, a relaxation of the Policy may be considered in exceptional circumstances.

 

In response to a question from Members Mr Leigh confirmed that he intended to use the vehicle for Executive travel and airport transport.  He explained that his vehicles were all kept in excellent condition as he wanted his customers to enjoy travelling with his company and believed this was the reason his customers gave him repeat business. He confirmed the service history of the vehicle and explained the vehicles safety features including airbags.

 

The Sub-Committee retired to consider their decision and on their return their decision was:

 

RESOVLED:               The Sub-Committee noted that due to the age of the vehicle the application fell outside of the licensing policy.  The Sub-Committee however noted the exceptions allowed under their policy and in particular relating to the above vehicle they noted:

 

o   The exceptional standards of safety, especially the air bags

o   The service history of the vehicle

o   The exceptional condition (both interior and exterior) with no sign of wear or damage

 

The Sub-Committee therefore granted the application

Exclusion of the Public

The reports relating to the following items are not for publication as they

contain exempt information as defined in Paragraph 12 of Part 4 and/or Paragraph 21 of Part 5 of Schedule 12A of the Local Government Act 1972 as amended by the Local Government (Access to Information)(Variation)(Wales) Order 2007.

 

If following the application of the public interest test the Committee resolves pursuant to the Act to consider these items in private, the public will be excluded from the meeting during such consideration.

Minutes:

RESOLVED:               That under Section 100A(4) of the Local Government Act 1972 as amendedby the Local Government (Access to Information) (Variation) (Wales) Order 2007, the public be excluded from the meeting during consideration of the following items of business as they contain exempt information as defined in Paragraphs 12 of Part 4 and Paragraph 21 of Part 5 of Schedule 12A of the Act.

 

                        Following the application of the public interest test it was resolved that pursuant to the Act referred to above to consider the following items in private, with the public excluded from the meeting, as it was considered that in all the circumstances relating to the items, the public interest in maintaining the exemption outweighed the public interest in disclosing the information, because the information would be prejudicial to the applicants.
