Cyflwynodd Pennaeth y Gwasanaethau Cyfreithiol a Rheoleiddiol adroddiad, yn gofyn i'r Is-bwyllgor ystyried cais i roi trwydded ar gyfer Cerbyd Hacni.

 

Gwnaed y cais gan Douglas R Wilson i drwyddedu Citroen Belingo Multispace, rhif cofrestru'r cerbyd CA67 MZZ, fel cerbyd hacni gyda lle i 4 person eistedd. Roedd perchennog blaenorol i'r cerbyd ac fe'i cofrestrwyd i ddechrau gan y DVLA ar 16 Chwefror 2018.

 

Gohiriwyd y cyfarfod am amser byr er mwyn i'r Aelodau gael archwilio'r cerbyd.

 

Ar ôl ailgychwyn y cyfarfod, dywedodd y Swyddog Cyfreithiol wrth yr aelodau mai 4,291 oedd nifer milltiroedd cyfredol y cerbyd. Dywedodd fod y cerbyd yn syrthio y tu allan i'r Polisi Cerbydau Hacni a gymeradwywyd gan y Pwyllgor Trwyddedu. Nid oedd mynediad ynddo i gadair olwyn, ond roedd canllawiau polisi penodol gyda golwg ar drwyddedu Cerbydau Hacni am y tro cyntaf oedd yn syrthio y tu allan i ganllawiau’r polisi a amlinellwyd ym mharagraff 4.5 o’r adroddiad.

 

Er gwybodaeth i’r aelodau, nid oedd hanes gwasanaeth wedi ei ddarparu gan nad oedd y gofyniad am wasanaeth i’r cerbyd wedi ei gyrraedd eto. Edrychodd swyddog gorfodi ar y cerbyd ar 10 Hydref 2018 a chadarnhaodd mai nifer y milltiroedd yr adeg honno oedd 3,867. Cyflwynwyd y cerbyd mewn cyflwr da heb ddim problemau na diffygion gweladwy.

Cyflwynodd Pennaeth y Gwasanaethau Cyfreithiol a Rheoleiddiol adroddiad, yn gofyn i'r Is-bwyllgor ystyried cais i roi trwydded ar gyfer Cerbyd Hurio Preifat.

 

Gwnaed y cais gan Zahide Ahmed i drwyddedu Skoda Octavia, rhif cofrestru'r cerbyd BL16 YSM fel cerbyd hurio preifat gyda lle i 4 person eistedd. Roedd perchennog blaenorol i'r cerbyd ac fe'i cofrestrwyd i ddechrau gan y DVLA ar 01 Gorffennaf 2016.

 

Gohiriwyd y cyfarfod am amser byr er mwyn i'r Aelodau gael archwilio'r cerbyd.

 

Ar ôl ailgychwyn y cyfarfod, dywedodd y Swyddog Cyfreithiol wrth yr aelodau mai 14,543 oedd nifer milltiroedd cyfredol y cerbyd. Dywedodd fod y cerbyd yn syrthio y tu allan i'r Polisi Cerbydau Hurio Preifat a gymeradwywyd gan y Pwyllgor Trwyddedu. Nid oedd mynediad ynddo i gadair olwyn, ond roedd canllawiau polisi penodol gyda golwg ar drwyddedu Cerbydau Hurio Preifat am y tro cyntaf oedd yn syrthio y tu allan i ganllawiau’r polisi a amlinellwyd ym mharagraff 4.5 o’r adroddiad.

Gwnaed y cais gan Prince K Ugbodu i drwyddedu Toyota Avensis, rhif cofrestru'r cerbyd FJ13 RBF fel cerbyd hurio preifat gyda lle i 4 person eistedd. Roedd perchennog blaenorol i'r cerbyd ac fe'i cofrestrwyd i ddechrau gan y DVLA ar 01 Gorffennaf 2016.

 

Gohiriwyd y cyfarfod am amser byr er mwyn i'r Aelodau gael archwilio'r cerbyd.

 

Ar ôl ailgychwyn y cyfarfod, dywedodd y Swyddog Cyfreithiol wrth yr aelodau mai 141,065 oedd nifer milltiroedd cyfredol y cerbyd. Dywedodd fod y cerbyd yn syrthio y tu allan i'r Polisi Cerbydau Hurio Preifat a gymeradwywyd gan y Pwyllgor Trwyddedu. Nid oedd mynediad ynddo i gadair olwyn, ond roedd canllawiau polisi penodol gyda golwg ar drwyddedu Cerbydau Hurio Preifat am y tro cyntaf oedd yn syrthio y tu allan i ganllawiau’r polisi a amlinellwyd ym mharagraff 4.5 o’r adroddiad.

 

Er gwybodaeth i’r aelodau, roedd hanes gwasanaeth wedi ei ddarparu oedd wedi ei restru yn Atodiad A yr adroddiad yn ogystal â MOT dyddiedig 23 Mai 2018 a nifer y milltiroedd oedd wedi eu cofnodi yr adeg honno oedd 127,206. Edrychodd swyddog gorfodi ar y cerbyd ar 26 Medi 2018 a chadarnhaodd mai nifer y milltiroedd yr adeg honno oedd 139,391. Cyflwynwyd y cerbyd gyda'r diffygion canlynol:

Marciau crafu ar y gwaith paent; y bymper ôl ar yr ochr i mewn a'r sil, y bymper blaen ar yr ochr i mewn, golau niwl ôl a'r drws ffrynt ar yr ochr allan (rhan isaf).

Nid oedd y cofnodion ac adroddiadau sy'n ymwneud â'r eitemau canlynol yn cael eu cyhoeddi, gan fod eu bod yn cynnwys gwybodaeth eithriedig fel y'i diffinnir ym Mharagraff 12 o Ran 4 a Pharagraff 21 o Ran 5, Atodlen 12A, Deddf Llywodraeth Leol 1972, fel y'i newidiwyd gan Orchymyn Llywodraeth Leol

The Team Manager (Licensing) asked the applicant if the details in the report were correct, the applicant stated that he was in the process of moving address during this time and gave details of his new address which is listed below.

The applicant was then asked if there were any outstanding convictions or penalties to which he replied no.

 

She stated that the reason for the hearing was that the convictions triggered the policy at 2.3, 2.4 and 2.6 for offences relating to traffic offenses, major traffic offenses and alcohol or drugs.

 

She then asked Mr George if he could provide details relating to each of the convictions, starting with the offence dated 26/05/2011 for driving a motor vehicle with excess alcohol.

 

The applicant explained that he was with his partner at the time and had a few drinks. He was involved in an argument that escalated and his partner kicked him out the house. The applicant was living with his mother at the time but she wasn’t available to pick him up, he decided to drive home as he felt able to drive and did not feel drunk. He was pulled over shortly after leaving the partners house and was found to be over the legal limit to drive.

 

A Member asked was he driving dangerously or was there any other reason he was pulled over. The applicant responded saying that he was not sure but believes the police were already on the way to the house because his partner may have phoned them during the argument. 

 

The Team Manager (Licensing) asked the applicant to give his account of the offence dated 17/07/2012 for possession of a Class B drug – Mephedrone.

 

The applicant explained that he was going to a night club with a friend, and was asked to look after his wallet for him. Upon entry to the club, the security at the club searched both the applicant and his friend. When security opened the wallet it was found to contain the Mephedrone. The applicant told the committee that he didn’t want to get his friend in trouble so took ownership, and therefore the blame for the wallet. He was charged as a result.

 

The Team Manager (Licensing) asked the applicant to give his account of the conviction dated 05/07/2017 for TT99 “Totting up”.

 

He explained that he worked for a company in Porthcawl at the time where he took the work van home regularly. When he took the vehicle back in to work for vehicle checks, he was notified shortly after that the vehicle was captured by CCTV for speeding. He informed his workplace that he was not in possession of the vehicle at this time and asked for the CCTV footage as he explained that a friend drove the vehicle at this time. He did not give his details of this driver and therefore was given 6 points for failing to provide  ...  Gweld y cofnodion lawn ar gyfer eitem 102.

The Team Manager (Licensing) asked the applicant he had a copy of the report if the details were correct. The applicant said he had a copy and the details were correct. He was then asked if he had received any convictions, penalties or ongoing matters since the report to which he replied no.

 

The Team Manager (Licensing) asked the applicant to give his account of the conviction dated 05/01/2016 for failure to give information as to identity of driver.

 

The applicant explained that at the time of this incident he was on holiday. During this time, he had let his friend borrow the vehicle as he needed it to transport his children. The applicant trusted his friend with the paperwork as he was diagnosed with Parkinson’s and struggled to write.

 

During the applicant’s time away, his friend incurred a speeding fine while driving 33 mph in a 30mph limit area near the Princess of wales hospital, Bridgend. The applicant said that he left it too long to deal with everything and was therefore charged.

 

A Member asked whether the driver offered to pay the fine or put himself forward and take responsibility; the applicant said he did not.

 

RESOLVED: The Sub Committee considered the application and the details relating to the conviction. The applicant stated that he allowed a friend to drive the vehicle and incurred a speeding ticket during this time.

 

The applicant accepted responsibility for not completing the necessary paperwork in time and understands the conviction as a result.

 

The Sub Committee saw no reason for refusal and therefore made the decision to grant the licence.

The Team Manager (Licensing) asked the applicant he had a copy of the report if the details were correct. The applicant said he had a copy and the details were correct. He was then asked if he had received any convictions, penalties or ongoing matters since the report to which he replied no.

 

The Team Manager (Licensing) asked the applicant to give his account of the conviction dated 18/08/1976 for ‘Handling’ as part of the Theft Act 1968.

 

The applicant explained that he was in school at the time. His friend had found some money on the floor and decided to split it with the applicant. The applicant said that the school must have though the money was stolen. The friend and the applicant were charged for it, fined £5 and paid £1.50 compensation.

 

The Team Manager (Licensing) asked the applicant to give his account of the conviction dated 30/03/1983 for the offences relating to the Public Order Act 1936 and Criminal Damage Act 1971.

 

The applicant explained that he was around 19 years old at the time and attending a stag party. He was with group of around 12 people and they were under the influence of alcohol. They were all playing pranks on each other and ‘messing around and swearing’ and some of them in the group were pushed into a hedge. The whole group were charged because of this.

 

The Team Manager (Licensing) asked the applicant to give his account of the conviction dated 02/03/2000 for Assault Occasioning Actual Bodily Harm.

 

The applicant said at the time he was working for a lighting company that was contracted to the electric board. At the end of his work shift, he would take the equipment and vehicle home with him, he was given permission to do this by his boss.

 

One of his neighbours was complaining about the time of night he was arriving home which the neighbour believed was too late. He also complained that the applicant was taking equipment from the van, which he explained that he had permission for.

 

The applicant explained that he spoke to the son of the neighbour and he said he was the one passing the information on to his father who then made the complaints. The argument became heated until the son of the neighbour attempted to attack the applicant; he then defended himself and hit him back. He was charged for the attack and pleaded guilty for it.

 

The Team Manager (Licensing) asked the applicant to give his account of the conviction dated 11/01/2016 for TT99 – “Totting Up”

 

The applicant explained he already had 3 points on his licence before this time. He then obtained 6 points on the motorway which occurred when he drove too fast during a temporary speed restriction, causing him to be almost 20mph over that limit. He explained that he was late for a job so did not pay attention to the temporary speed restriction  ...  Gweld y cofnodion lawn ar gyfer eitem 104.

The Sub Committee have considered the seriousness of the offense and the interest of public safety and therefore made the decision to revoke the licence.
